NHTSA Probes Comma.ai Hands-Off Tech After Two Fatal Crashes

NHTSA's Office of Defects Investigation opened a preliminary probe of Comma.ai's aftermarket hands-off driver-assistance devices after five reported crashes in which the equipped vehicle hit a slow-moving or stopped vehicle in its lane. Two of those crashes were fatal, killing three people, with up to 11 more injured across four incidents, per TechCrunch.

The one crash regulators have publicly named happened in Ascension Parish, Louisiana, in February 2026. A 2022 Toyota RAV4 running FrogPilot, a third-party fork of Comma's openpilot software, struck a stopped Gonzales Police Department cruiser positioned in the left lane with its emergency lights on. Two rear-seat passengers in the RAV4 died.

Comma.ai, founded in 2015 by George Hotz, sells a device that installs into modern cars and runs openpilot to handle Adaptive Cruise Control and Automated Lane Centering, functions the company likens to Tesla Autopilot and GM Super Cruise. Its own site acknowledges that openpilot performance can be affected by "vehicles in the same lane that are not moving," and that the system is "designed to be limited" in abrupt braking scenarios.

ODI added that some of the crashes, including at least one fatal one, "might have involved the use of modified or 'forked' versions" of Comma's software, a wrinkle that puts the boundary between the company's shipped code and community builds squarely on the regulatory record.
