xAI Describes 59 Unpermitted Gas Turbines as 'Phase One of Phased Permitting Approach'

SOUTHAVEN, MISS.—Following a Reuters investigation identifying 59 natural-gas turbines powering its Colossus 2 data center without required federal clean-air permits, xAI released a statement Tuesday describing the sequence as "proactive infrastructure deployment in advance of the regulatory framework" and confirmed it would apply for the relevant authorizations "on a timeline that reflects the pace of innovation."

The turbines—57 of which sit in Southaven, Mississippi, adjacent to predominantly Black communities that have experienced elevated particulate exposure since the units came online last November—were characterized by xAI as "Phase One of a phased permitting approach." In the approach, construction precedes authorization by design, allowing regulators to assess actual equipment performance rather than projections.

"We think real-world data is more informative than models," said an xAI spokesperson, who did not specify which federal models the company had declined to file.

The EPA's permitting review for stationary combustion sources typically runs 24 to 28 months. Colossus 2 has been operational for eight.

Internal documents reviewed by The Artifice describe the compliance gap as a "first-mover regulatory position" that creates "a durable barrier to entry for competitors who file first."

Affected Southaven residents were invited to submit public comments via a portal whose footer notes that submissions are "monitored on a best-effort basis." The comment window closes September 3.

"The communities near our Memphis facility are partners in what we are building," the company said.

The nearest residential street is 0.4 miles from the nearest turbine. Its residents did not receive a notification that they had been enrolled as partners.
