I just read the statement that the US DOJ filed in the NY Times v. OpenAI case. It strongly argues that LLM reading of copyrighted works for training is fair use. It also rejects Copyright Office's pre-publication theory of "market dilution" for AI outputs. It cites @edleeprof.bsky.social.
Quick initial take on Thompson-Reuters v Ross: opinion is a narrow holding w.r.t. a particular (and somewhat unusual) set of facts that don't go to the core fair use questions in generative AI training.
This is not at all intentional, but beginning tomorrow Anthropic is going to be inundated by users eager to get their hands on the model that is too dangerous for mortals to touch. Forbidden fruit meets possible compute constraints.
